Leaves Kalispell because he feels he can no longer carry out his duties as a civil court judge. His main reason for leaving is because Elias Steelgrave has information about a past (when he was in his twenties) incident involving Ben in a illegal duel. Ben killed the man and has a murder charge hanging over his head in the state where incident occured. Steelgrave used this information to get Ben to delay the hospital contract signing for as long as possible. However, Ben decides it is better to leave town.
Ben and his wife go to Helena, where Ben goes to see the Governor and resigns.
